These Terms and Conditions (Terms) establish the binding contract between you (Customer) and us for all products (Products) available for purchase on our website (Platform). These Terms form the complete commercial agreement (Purchase Agreement) that applies to every transaction you make with us for any Products offered through our Platform.
We strongly recommend that you carefully read and understand these Terms in their entirety prior to making any purchase. Your acceptance of these Terms is mandatory to complete any transaction on our Platform. By proceeding with a purchase, you acknowledge that you have read, understood, and agree to be bound by these Terms.
If you do not agree to these Terms, you are not authorised to purchase any Products through our Platform and must discontinue use of our purchasing services immediately.
1. Formation of Agreement
1.1 You must be 18 years of age or older to utilise this website. By submitting an order, you confirm that you are at least eighteen (18) years of age and legally capable of entering into binding agreements.
1.2 Product listings on our website are invitations to purchase and do not constitute contractual offers. Your order submission is deemed an offer, which we may accept or reject at our discretion.
1.3 A binding contract arises only when we issue an electronic confirmation of payment acceptance.
2. Prices and Payment
2.1 All prices are listed in the displayed currency and are subject to change without notice.
2.2 Unless otherwise specified, prices exclude shipping, handling, import duties, customs charges, and taxes, which remain the responsibility of the Customer.
2.3 Payments are processed via secure third-party payment providers. We do not store credit card or banking details.
3. Shipping and Delivery
3.1 We endeavour to process and dispatch orders promptly. Normal dispatch time is 1-2 business days. Any delivery timeframes provided are estimates only and are not binding.
3.2 If a product is temporarily unavailable, Customers will be notified of the delay and may be offered alternatives or cancellation.
3.3 Orders are shipped to the delivery address provided by the Customer. Risk of loss, damage, or theft transfers to the Customer upon delivery by the carrier.
3.4 We are not responsible for shipping delays, customs restrictions, or legal limitations that prevent delivery in the Customer’s jurisdiction.
4. Cancellations and Returns
4.1 Customers may cancel an order within three (3) business days of delivery by written notice. Returned goods must be unopened, unused, and in their original packaging.
4.2 All return shipping costs and risks are borne by the Customer.
4.3 Refunds will be processed within fourteen (14) days of receipt of returned goods in acceptable condition, subject to a restocking fee of thirty percent (30%).
4.4 For health and safety reasons, opened or used e-liquids cannot be returned under any circumstances.
4.5 If goods show signs of misuse, negligence, or damage caused by the Customer, we may reduce or deny a refund.
5. Warranties and Limitation of Liability
5.1 We provide no warranties beyond those offered by the relevant manufacturer.
5.2 To the fullest extent permitted by law, we disclaim liability for indirect, incidental, or consequential damages, including lost profits, data loss, or business interruption.
5.3 In any event, our liability shall not exceed the original purchase price of the product giving rise to the claim.
5.4 We shall not be responsible for delays or non-performance caused by events outside of our reasonable control, including but not limited to natural disasters, transport disruptions, strikes, or government actions.
5.5 These Terms do not affect any statutory consumer protections that cannot be excluded by law.
5.6 Warranty rights are void where goods have been altered, misused, or returned without proof of purchase.
6. Product Use and Health Warnings
6.1 All e-liquids sold by us are intended exclusively for use with appropriate vaping devices. They are not medical products and are not intended to diagnose, treat, or prevent any health condition.
6.2 We supply nicotine-free e-liquids only.
6.3 Products are unsuitable for minors under eighteen (18), pregnant or breastfeeding women, or persons with health conditions such as heart disease, high blood pressure, or diabetes, unless cleared by a qualified medical professional.
7. Privacy and Data Protection
7.1 Customer data is collected, stored, and processed in accordance with our Privacy Policy and applicable data protection legislation. By engaging with our services, you consent to such processing.
8. Warranty and Returns Policy for Defects
8.1 Products that are damaged upon delivery may be eligible for replacement.
8.2 Due to hygiene and safety concerns, consumable products such as e-liquids cannot be returned once opened or used, except where a manufacturing defect is identified.
9. Product Descriptions and Illustrations
9.1 All product descriptions, images, and graphics provided on our website are for informational and illustrative purposes only. While we endeavour to ensure accuracy, the actual product received may differ in appearance, packaging, or minor details from the illustrations shown. Such variations do not constitute defects or grounds for return.
9.2 We accept no liability for discrepancies between the illustrative content and the delivered product.
10. General Provisions
10.1 These Terms constitute the complete agreement between us and the Customer and supersede all prior agreements, statements, or representations.
10.2 If any provision of these Terms is deemed invalid or unenforceable, the remaining provisions shall remain in full effect.
10.3 These Terms shall be governed by and construed in accordance with the laws applicable to our jurisdiction. Any disputes shall be submitted exclusively to the competent courts of that jurisdiction.
10.4 Our failure to enforce any right or provision shall not constitute a waiver of such right or provision.
